Terms and Conditions

1. Contract Purpose
This contract governs the relationship between jdhholidaytenerife.com (hereinafter referred to as "we") and the customer (hereinafter referred to as "Customer") in relation to the services offered through our platform, including but not limited to the listing and booking of vacation accommodations.
These Terms are supplementary to our Privacy Policy, Cookie Policy, and any other regulations we publish on our website.
Access to and use of the Services (as defined below) are solely subject to the following terms and conditions ("Terms of Service").
By using the services on jdhholidaytenerife.com, the Customer fully accepts these Terms of Service, including the Privacy Policy (available at Privacy Policy) and the Data Processing Addendum ("DPA"). If the Customer does not accept these Terms of Service, including the Privacy Policy and DPA, they must immediately stop using the Services. If the Customer continues to use the Services, it will be considered that they have agreed to be bound by these Terms of Service, including the Privacy Policy and DPA.

2. Definitions
a) The term “jdhholidaytenerife.com”, "we", "us", or "our" refers to JDH PROPERTIES TENERIFE, a company incorporated in the Commercial Registry under identification number TF41871.
b) The term “jdhholidaytenerife.com” refers to our website jdhholidaytenerife.com.
c) The term "Services" refers to all services provided by jdhholidaytenerife.com at any time, including but not limited to receiving booking information through our booking and payment system, managing bookings and payments, responding to the Customer through our booking system, and managing content on third-party channels via our channel manager.
d) The term "Customer" refers to: a) the individual who registers for a Customer Account in their own name; or b) the organization, if the individual registers for a Customer Account on behalf of an organization.
e) The term "Customer Account" refers to the account that the Customer creates on jdhholidaytenerife.com to access and use the Services.
f) The term "Property" refers to any form of accommodation, building, houseboat, apartment, room, apartment blocks, houses, or other rental spaces that the Customer or a third-party channel displays and offers for rent using the Services.
g) The term "Content" refers to text, graphics, images, music, software, audio, video, information, or other data.
h) The term "Customer Content" refers to the Content provided by the Customer as part of the use of the Services, including but not limited to other information.
i) The term "Owner" refers to the individual or legal entity that registers their property on the jdhholidaytenerife.com website and accepts the booking policies and terms as outlined in the contract between both parties.

3. Registration and Access
• The Customer must be at least 18 years old to register and use the services.
• Upon registration, the Customer agrees to provide truthful, complete, and up-to-date information.
• The Customer is responsible for maintaining the confidentiality of their login credentials and all activities carried out from their account.
Prohibited Uses:
The Customer may not:
• Impersonate another person or entity.
• Use the platform for illegal activities or activities against public morals and order.
• Introduce viruses or engage in activities that affect the functionality of the site.

4. Services Offered
The platform allows:

  1. Property owners to publish ads for vacation rentals.
  2. Guests to search, book, and manage vacation stays.

5. Fees and Payments
• The fees include:

  • Subscription fees for property owners (if applicable).
  • Commission for bookings based on the percentage outlined during the contracting process.
  • Other additional services offered on the platform.
    Taxes:
    All prices include applicable taxes unless stated otherwise.
    Cancellations and Refunds:
    • The customer must immediately notify any cancellations by email. If the booking is canceled more than 8 weeks in advance, the Customer will forfeit the deposit paid. If the cancellation occurs less than 8 weeks before the holiday, the full balance remains due and is non-refundable.
    • JDH Properties Tenerife encourages the Customer to purchase travel insurance to protect against potential cancellations that may incur costs.

6. Intellectual Property
All content on the website, including text, images, software, and logos, is the exclusive property of JDH PROPERTIES TENERIFE or its licensors and is protected by Spanish intellectual property laws.
The Customer and the Owner may not reproduce, distribute, modify, or use the content of the website without express authorization.

7. Data Protection
We comply with the General Data Protection Regulation (GDPR) and the Organic Law on Data Protection and the Guarantee of Digital Rights (LOPDGDD).
Data We Collect:
• Registration data (name, email, etc.).
• Transaction and booking data.

8. Responsibilities
Customer Responsibilities:
• Provide truthful and up-to-date information.
• Respect the rules of conduct in the accommodations booked.
• Use the site ethically and within the limits of the law.
Limitation of Liability:
We are not responsible for:
• Indirect damages or loss of profits arising from the use of the platform.
• Breaches of agreements between owners and guests.
Our total liability is limited to the amount paid by the Customer in the 12 months prior to the incident.

9. Prohibited Actions
It is strictly prohibited to:
• Use robots, spiders, or other automated methods to collect data from the site.
• Introduce content that is illegal, offensive, discriminatory, or contrary to public morals.
• Post content that infringes the rights of third parties (intellectual property, privacy, etc.).

10. Modification of Terms
We reserve the right to modify these Terms. Any major changes will be notified at least 30 days in advance.
Continued use of the site after such notice will imply acceptance of the new Terms.

11. Dispute Resolution
We will attempt to resolve any conflict amicably. If no agreement is reached, the parties agree to submit to the jurisdiction of the courts of Granadilla de Abona (Santa Cruz de Tenerife, Spain), expressly waiving any other jurisdiction that may apply.

12. Applicable Law
This contract will be governed and interpreted in accordance with Spanish law, especially the General Law for the Defense of Consumers and Users and other applicable regulations.

Annex: Cancellation and Refund Policy

For Owners:

• Cancellations outside the specified period may incur penalties as per the specific agreement.

For Guests:

• Cancellations within the specified time frame will receive a partial refund of the amount paid.

• Cancellations outside the specified time frame will be subject to the specific terms of the accommodation.
